Come to Order
"Now, in the interest of erring on the side of caution, this court will have none of 'the subject' or 'the product'. The being self-identifying as 'John 'Jack' Smith', will be referred to as 'him', or 'the individual' if the plaintiffs insist on being clinical." The judge cast a stern eye around the courtroom. There was more than a fair representation both of the Thunderbolts and the Leap Foundation. A few notable superheroes with impressive civilian credentials, such as Doctors Pym and Samson, were also on the witness list.

Some shuffling of papers and agreements are issued, before the lawyer for the Leap Foundation steps up.

"We call Beatrice Dayspring to the stand."

Bea steps up, rolls her eyes as she imagines blowing up the Leap Foundation on principle -- and she still just might -- and affirms that she will tell the truth, because they do not want to get into her religion.

Primm is there again, all but rocking on his heels as he's now in his element. He approaches Bea as soon as she's sworn in, leaning on the guardrail in front of her seat, getting right into her personal space.

"Miss Dayspring... how would you characterize the individual's behavior, in regard to crime-fighting?"

Awwww, is he trying to make Beatrice uncomfortable? With the sister she's got? Beatrice just looks at him.

Jack sat uncomfortably at a table off to one side by the bailiff. The next table over from him was marked 'Evidence'. It had taken some coaxing, but he'd managed to approximate a three piece suit for his day in court.

"So his behaviors aren't so much normal behavior as just set responses. The kind you could get out of any programmable device." Primm quickly adds on.

"No further questions for the witness, your honor." He speaks quickly, before heading back to his desk.

The judge bristles slightly, and casts an eye towards Bea, then to the rest of Jack's legal counsel. "Do the plaintiffs have any questions for the witness? If not, Miss Dayspring may step down."

"By the way, your honor, the applicable term there is 'Objection, leading the witness. Mr. Primm, since you can't be expected to actually know the law, think of it like jeopardy. Your questions need to be phrased in the form of, you know, questions."

Bea is just staring in wonder at the fact that the guy just stated the opposite of what she'd said as if it was what she'd said. Then she smiles at her sister.

There will be no questions for the witness, jsut the entrance of the full psych eval into evidence.

The judge nods to Kelly. "Sustained, Miss Wilson." He looks towards Primm. "Let's try to keep the theatrics to a minimum, Mister Primm."

Primm clears his throat and looks away, before going over his papers again. "We call Anya Antonovna Romanova Stark to the stand."

"So, we have previously submitted a full psych evaluation by Dr. Leonard Samson, whose credentials are well established. I could call Dr. Samson to the stand, but to save the court's time, let me quickly review what we'd go over, and I'll call him if the defense /really/ wants to drag this out.

There's no single agreed upon definition of sentience, because there are three major psychological boards in the world - by some defintions, highly intelligent animals like dolphins, apes and elephants are sentient. In others, advanced computers - which is obviously up for dispute. But the general definitions go that the basic requirements for sentience are:
capability to interact with other living things and your environment in a meaningful way, capability to perform basic reason and processing - math being a common test, self-awareness, and ability to learn and change behaviors based upon experience... with the last one being the primary thing up for debate. Dr. Samson would testify to most of those, but his paperwork includes all that information. I'll call him if defense wants to cross-examine... but I'll admit, to help defense, that he can only testify to the first three, not the last.

If defense doesn't want to dispute anything in his documentation, I'll proceed and call our only witness. What's it going to be, counselor?"

Jack is incredibly nervous, but nods to his teammates and walks up to the stand. He's sworn in, fighting back his insti-- his programming to have a smart-ass remark ready.

"I swear."

And then he sits down and looks at Kelly.

Right on schedule, everyone is back in court.

"Good afternoon everyone, be seated, except you, young man." The judge gets right to work, addressing Jack.

"No judge looks forward to a case like this. It demands of us to adhere only to our knowledge of the law, even when we would be tempted to make our judgements based on what we think we know about science, be it genetics or psychology or any field you could name.

Young man, your origins are singular. We have similar precedents in our society, for clones, for androids, for children of alien and human unions... and you are something new. We've heard testimony both on your physical and mental state. You've reported for each hearing with your counsel and listened to discussions that... I can't even imagine how discomfiting they must be for you.

In everything this court has witnessed, it has observed you to be aware of your surroundings, capable of making sound, if somewhat uninformed, judgements, and behaving in a manner that conveys respect for the laws of this country and it's officiates.

Therefore, while this court does not have the power to pronounce you human, it sees no reason not to award you personhood status. In addition, this court mandates further psychological evaluation, to determine an approximate legal age for you as applicable to federal laws regarding licensing and eligibility. If you are found to be under 18 in the eyes of a court-approved evaluation, you will be appointed a legal guardian, whose fitness for that role will be determined by a subsequent hearing. You will be awarded a permanent resident visa under the provisions set forth the Artificial Americans Act, until you are deemed old enough to apply for citizenship. During your residence in this country, you will be expected to abide by all state and federal laws.

Do you understand everything I am telling you, young man?"

Jack nods and manages to squeak out a response of, "Yes, your honor." He's not sure if he wants to cry or dance.

Definitely dance. There's no crying if you're a superhero.

"Then, by the power vested in me by the state of New York, I hereby pronounce you Mister John Smith. You may be seated, and when court is dismissed, you are free to go wherever you like, Mister Smith."

After Jack seats himself, the judge turns a more tired than predatory eye to the Leap Foundation's legal team. "I will be referring all materials, evidence, and testimony related to this trial to the District Attorney's Office for evaluation as to what, if any, criminal charges to be pressed. I strongly advise all members of their legal team, board of directors, and any contractors involved in Mr Smith's cultivation not leave the city.

Court is dismissed."

Jack pretty much vaults himself away from his seat at the evidence table, closing the distance between himself and Bea in a single bound, landing next to her chair.

"So... we won?" He smiles, still not entirely sure what all the legal stuff means, but he's a 'Mister' now, which is pretty awesome.
