There was, technically, between jobs at the moment. With the overall demise of Camp Hammond and the Sentinel Squad O.N.E., Norman Osborn's administration no longer being an obstacle, he was out of things to do.
Tony, of course, had a standing offer out to come back and work for him any time. Definitely an option to consider, though Tony's only difficulties in putting his life back together made him consider giving his friend the time and space he needed.
The government was also interested in employing him again, wanting an Iron Man on their payroll.
Currently, however, he was in a Starbucks, near Arlington, Virginia, having come from a meeting at the Pentagon.
